These Terms & Conditions ("Terms") govern your access to and use of EccMaintain(the "Service"), provided by EccMaintain ("we", "us", "our"). By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
EccMaintain is a computerised maintenance management system (CMMS) that helps organisations track assets, work orders, preventive maintenance, parts inventory, procedures, and related maintenance operations. Features available to you depend on the plan you subscribe to.
You must be of legal age in your jurisdiction and, if you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.
You agree not to misuse the Service. In particular, you must not:
The Service, including its software, design, documentation, and branding, is and remains the property of EccMaintain and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. You retain ownership of the content and data you submit to the Service. You grant us a limited licence to host and process that content solely to provide the Service to you.
Paid plans are sold by EccMaintain through our reseller. Payment mechanics — including billing frequency, taxes, invoicing, currency conversion, cancellations, and refunds — are handled by Paddle in accordance with the Paddle Buyer Terms. Subscriptions renew automatically at the end of each billing period at the then-current plan price until cancelled.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
We work hard to keep the Service running reliably, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. Scheduled maintenance, third-party outages, or events outside our reasonable control may affect availability.
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. You are responsible for how you use the Service and for verifying that it is suitable for your operations.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or in connection with the Service is capped at the fees you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
You will indemnify and hold us harmless from any claim, loss, or expense arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law or the rights of any third party.
We may suspend or terminate your access to the Service, in whole or in part, if you materially breach these Terms, fail to pay when due, present a security or fraud risk, or if we are required to do so by law. Where reasonable, we will notify you first and give you an opportunity to cure the issue. You may cancel your subscription at any time through your account or through Paddle. On termination, your right to use the Service ends and we may delete your data after a reasonable retention window.
We may update the Service and these Terms from time to time. If we make a material change, we will notify you by a reasonable means. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws applicable at the seller's place of establishment, without regard to conflict-of-law rules. Where mandatory consumer protection law grants you additional rights, those rights are not affected.
